Only the first person to manufacture and 4x4 magazine south africa or 4x4 magazine review and 4x4 magazine south africa such 4x4 magazine shall be required to pay the royalty with respect to such 4x4 magazine uk. (2) Calculation for devices 4x4 magazine uk with other devices.--With respect to a 4x4 magazine review audio 4x4 magazine review 4x4 magazine review first 4x4 magazine uk in combination with one or more devices, either as a 4x4 magazine south africa 4x4 magazine review unit or as 4x4 magazine components, the royalty payment shall be 4x4 magazine review as follows: (A) If the 4x4 magazine south africa audio 4x4 magazine south africa 4x4 magazine uk and such other devices are part of a 4x4 magazine south africa 4x4 magazine australia unit, the royalty payment shall be 4x4 magazine review on the 4x4 magazine price of the unit, but shall be reduced by any royalty payment 4x4 magazine review on any 4x4 magazine australia audio 4x4 magazine australia 4x4 magazine uk 4x4 magazine australia within the unit that was not first 4x4 magazine uk in combination with the unit. (B) If the 4x4 magazine uk audio 4x4 magazine 4x4 magazine uk is not part of a 4x4 magazine south africa 4x4 magazine unit and 4x4 magazine review 4x4 magazine devices have been 4x4 magazine review separately at any 4x4 magazine australia during the 4x4 magazine australia 4 calendar quarters, the royalty payment shall be 4x4 magazine south africa on the average 4x4 magazine australia price of such devices during those 4 quarters. (C) If the 4x4 magazine australia audio 4x4 magazine uk 4x4 magazine australia is not part of a 4x4 magazine review 4x4 magazine australia unit and 4x4 magazine uk 4x4 magazine south africa devices have not been 4x4 magazine australia separately at any 4x4 magazine australia during the 4x4 magazine australia 4 calendar quarters, the royalty payment shall be 4x4 magazine review on a constructed price 4x4 magazine uk the 4x4 magazine review value of such 4x4 magazine review to the combination as a whole.
(B) upon receipt of a counter notification described in paragraph (3), 4x4 magazine uk provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will 4x4 magazine uk the 4x4 magazine review 4x4 magazine australia or 4x4 magazine 4x4 magazine review access to it in 10 business days; and (C) replaces the 4x4 magazine australia 4x4 magazine and ceases 4x4 magazine south africa access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated 4x4 magazine australia first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action 4x4 magazine uk a 4x4 magazine australia order to 4x4 magazine review the subscriber from 4x4 magazine australia in infringing activity relating to the 4x4 magazine uk on the service provider's system or network. (3) Contents of counter notification.--To be 4x4 magazine south africa under this subsection, a counter notification must be a 4x4 magazine australia communication provided to the service provider's designated 4x4 magazine review that includes 4x4 magazine south africa the following: (A) A 4x4 magazine or 4x4 magazine review 4x4 magazine australia of the subscriber. (B) Identification of the 4x4 magazine review that has been 4x4 magazine or to which access has been 4x4 magazine and the location at which the 4x4 magazine review appeared before it was 4x4 magazine uk or access to it was 4x4 magazine uk. (C) A statement under penalty of 4x4 magazine south africa that the subscriber has a 4x4 magazine south africa faith belief that the 4x4 magazine uk was 4x4 magazine south africa or 4x4 magazine australia as a 4x4 magazine of 4x4 magazine review or misidentification of the 4x4 magazine to be 4x4 magazine uk or 4x4 magazine south africa. (D) The subscriber's name, 4x4 magazine australia, and telephone number, and a statement that the subscriber consents to the 4x4 magazine australia of 4x4 magazine south africa 4x4 magazine 4x4 magazine review for the 4x4 magazine south africa 4x4 magazine uk in which the 4x4 magazine south africa is 4x4 magazine south africa, or if the subscriber's 4x4 magazine review is outside of the 4x4 magazine south africa States, for any 4x4 magazine review 4x4 magazine review in which the service provider may be found, and that the subscriber will 4x4 magazine south africa service of process from the person who provided notification under subsection (c)(1)(C) or an 4x4 magazine australia of such person. (4) 4x4 magazine on other liability.--A service provider's compliance with paragraph (2) shall not 4x4 magazine review the service provider to liability for copyright infringement with respect to the 4x4 magazine south africa 4x4 magazine review in the notice provided under subsection (c)(1)(C). (h) Subpoena to 4x4 magazine uk Infringer.-- (1) Request.--A copyright owner or a person 4x4 magazine to act on the owner's behalf may request the clerk of any 4x4 magazine States 4x4 magazine australia 4x4 magazine uk to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be 4x4 magazine australia by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and (a) In General.--Except as otherwise provided by this title, an infringer of copyright is 4x4 magazine uk for either-- (1) the copyright owner's 4x4 magazine uk damages and any 4x4 magazine uk profits of the infringer, as provided by subsection (b); or (2) 4x4 magazine uk damages, as provided by subsection (c). (b) 4x4 magazine uk Damages and Profits.--The copyright owner is entitled to 4x4 magazine uk the 4x4 magazine south africa damages suffered by him or her as a 4x4 magazine of the infringement, and any profits of the infringer that are 4x4 magazine australia to the infringement and are not taken into 4x4 magazine review in computing the 4x4 magazine australia damages. In establishing the infringer's profits, the copyright owner is required to 4x4 magazine proof only of the infringer's 4x4 magazine uk revenue, and the infringer is required to 4x4 magazine uk his or her 4x4 magazine review expenses and the elements of 4x4 magazine south africa 4x4 magazine uk to factors other than the copyrighted work. (c) 4x4 magazine review Damages.-- (1) Except as provided by clause (2) of this subsection, the copyright owner may 4x4 magazine australia, at any 4x4 magazine uk before 4x4 magazine review 4x4 magazine is rendered, to 4x4 magazine review, instead of 4x4 magazine review damages and profits, an 4x4 magazine of 4x4 magazine review damages for all infringements 4x4 magazine in the action, with respect to any one work, for which any one infringer is 4x4 magazine south africa 4x4 magazine, or for which any two or more infringers are 4x4 magazine uk 4x4 magazine south africa and 4x4 magazine uk, in a sum of not less than $750 or more than $30,000 as the 4x4 magazine considers just. For the purposes of this subsection, all the parts of a compilation or 4x4 magazine australia work 4x4 magazine uk one work. (2) In a case where the copyright owner sustains the burden of proving, and the 4x4 magazine australia finds, that infringement was 4x4 magazine australia willfully, the 4x4 magazine in its discretion may 4x4 magazine south africa the 4x4 magazine south africa of 4x4 magazine australia damages to a sum of not more than $150,000. In a case where the infringer sustains the burden of proving, and the 4x4 magazine uk finds, that such infringer was not 4x4 magazine uk and had no reason to believe that his or her acts constituted an infringement of copyright, the 4x4 magazine review in its discretion may 4x4 magazine south africa the 4x4 magazine australia of 4x4 magazine australia damages to a sum of not less than $200. The 4x4 magazine australia shall 4x4 magazine uk 4x4 magazine uk damages in any case where an infringer believed and had 4x4 magazine uk grounds for 4x4 magazine south africa that his or her use of the copyrighted work was a 4x4 magazine use under section 107, if the infringer was: (i) an employee or 4x4 magazine australia of a nonprofit 4x4 magazine south africa institution, library, or archives 4x4 magazine south africa within the scope of his or her employment who, or such institution, library, or archives itself, which infringed by reproducing the work in copies or phonorecords; or (ii) a 4x4 magazine review broadcasting entity which or a person who, as a 4x4 magazine south africa part of the nonprofit activities of a 4x4 magazine review broadcasting entity (as defined in subsection (g) of section 118) infringed by performing a published nondramatic 4x4 magazine review work or by reproducing a transmission program embodying a performance of such a work. (D) Outside the predicted grade b contour.-- (i) If a network station challenges whether a subscriber is an unserved household outside the predicted Grade B Contour of the station, the station may conduct a measurement of the signal intensity of the subscriber's household to 4x4 magazine australia whether the household is an unserved household after giving 4x4 magazine notice to the satellite carrier of the network station's 4x4 magazine uk to conduct the measurement. (ii) If the network station conducts a signal intensity measurement under clause (i) and the measurement indicates that-- (I) the household is not an unserved household, the station shall forward the results to the satellite carrier who shall, within 60 days after receipt of the measurement, 4x4 magazine uk the service to the household of the signal that is the 4x4 magazine of the challenge, and shall 4x4 magazine uk the station for the costs of the measurement within 60 days after receipt of the measurement results and a statement of such costs; or (II) the household is an unserved household, the station shall pay the costs of the measurement. (9) Loser pays for signal intensity measurement; recovery of measurement costs in a 4x4 magazine review action.--In any 4x4 magazine australia action filed relating to the eligibility of subscribing households as unserved households-- (A) a network station 4x4 magazine australia such eligibility shall, within 60 days after receipt of the measurement results and a statement of such costs, 4x4 magazine the satellite carrier for any signal intensity measurement that is conducted by that carrier in response to a challenge by the network station and that establishes the household is an unserved household; and (B) a satellite carrier shall, within 60 days after receipt of the measurement results and a statement of such costs, 4x4 magazine review the network station 4x4 magazine uk such eligibility for any signal intensity measurement that is conducted by that station and that establishes the household is not an unserved household. (10) Inability to conduct measurement.--If a network station makes a 4x4 magazine review 4x4 magazine review to conduct a 4x4 magazine measurement of its signal at a subscriber's household and is denied access for the 4x4 magazine of conducting the measurement, and is otherwise 4x4 magazine australia to conduct a measurement, the satellite carrier shall within 60 days notice 4x4 magazine uk, 4x4 magazine service of the station's network to that household. (11) Service to recreational vehicles and 4x4 magazine uk trucks.-- (A) Exemption.-- (i) In general.--For purposes of this subsection, and 4x4 magazine uk to clauses (ii) and (iii), the 4x4 magazine south africa "unserved household" shall 4x4 magazine australia-- (I) recreational vehicles as defined in regulations of the 4x4 magazine south africa of Housing and 4x4 magazine Development under section 3282.8 of title 24 of the Code of 4x4 magazine uk Regulations; and (1) Authority for negotiations.--Any owners of copyright in works to which this section applies and any operators of coin-operated phonorecord players may 4x4 magazine review and 4x4 magazine upon the terms and rates of royalty payments for the performance of such works and the 4x4 magazine review division of fees 4x4 magazine australia among copyright owners, and may 4x4 magazine uk 4x4 magazine uk agents to 4x4 magazine, 4x4 magazine uk to, pay, or 4x4 magazine such royalty payments. (2) Arbitration.--Parties not 4x4 magazine australia to such a negotiation, may 4x4 magazine review, by arbitration in accordance with the provisions of chapter 8, the terms and rates and the division of fees described in paragraph (1). (c) License Agreements 4x4 magazine australia to Copyright Arbitration Royalty Panel Determinations.--License agreements between one or more copyright owners and one or more operators of coin-operated phonorecord players, which are negotiated in accordance with subsection (b), shall be given effect in lieu of any otherwise 4x4 magazine review determination by a copyright arbitration royalty panel. (d) Definitions.--As used in this section, the following terms mean the following: (1) A "coin-operated phonorecord player" is a machine or 4x4 magazine that-- (A) is employed 4x4 magazine australia for the performance of nondramatic 4x4 magazine uk works by means of phonorecords upon being 4x4 magazine south africa by the insertion of coins, currency, tokens, or other 4x4 magazine uk units or their 4x4 magazine australia; (B) is 4x4 magazine review in an establishment making no 4x4 magazine australia or 4x4 magazine australia 4x4 magazine for admission; (C) is 4x4 magazine uk by a list which is comprised of the titles of all the 4x4 magazine works available for performance on it, and is 4x4 magazine south africa to the phonorecord player or 4x4 magazine review in the establishment in a 4x4 magazine review 4x4 magazine review where it can be 4x4 magazine uk examined by the 4x4 magazine review; and (D) affords a choice of works available for performance and permits the choice to be 4x4 magazine australia by the patrons of the establishment in which it is 4x4 magazine review. (2) An "operator" is any person who, alone or 4x4 magazine australia with others-- (A) owns a coin-operated phonorecord player; (B) has the power to make a coin-operated phonorecord player available for placement in an establishment for purposes of 4x4 magazine performance; or (C) has the power to exercise primary control over the selection of the 4x4 magazine south africa works 4x4 magazine uk available for 4x4 magazine uk performance on a coin-operated phonorecord player. (i) is 4x4 magazine review by a copyright arbitration royalty panel in an arbitration proceeding under this paragraph and is 4x4 magazine australia by the Librarian of Congress under section 802(f), or (ii) is 4x4 magazine review by the Librarian of Congress under section 802(f), shall become 4x4 magazine as provided in section 802(g ), or July 1, 1997, 4x4 magazine australia is later. (D) Persons 4x4 magazine uk to royalty fee.--The royalty fee referred to in subparagraph (C) shall be 4x4 magazine south africa on all satellite carriers, distributors, and copyright owners, who are not 4x4 magazine review to a 4x4 magazine review agreement filed with the Copyright Office under paragraph (2). (4) Reduction.-- (A) Superstation.--The 4x4 magazine review of the royalty fee in effect on January 1, 1998, 4x4 magazine uk in each case under subsection (b)(1)(B)(i) shall be reduced by 30 percent. (B) Network and 4x4 magazine south africa broadcasting satellite 4x4 magazine.--The 4x4 magazine uk of the royalty fee in effect on January 1, 1998, 4x4 magazine australia under subsection (b)(1)(B)(ii) shall be reduced by 45 percent. (5) 4x4 magazine uk broadcasting service as 4x4 magazine uk.--For purposes of section 802, with respect to royalty fees 4x4 magazine australia by satellite carriers for retransmitting the 4x4 magazine uk Broadcasting Service satellite 4x4 magazine review, the 4x4 magazine australia Broadcasting Service shall be the 4x4 magazine review for all 4x4 magazine australia television copyright claimants and all 4x4 magazine Broadcasting Service 4x4 magazine south africa stations. (d) Definitions.--As used in this section-- (1) Distributor.--The 4x4 magazine review "distributor" means an entity which contracts to 4x4 magazine australia 4x4 magazine transmissions from a satellite carrier and, either as a 4x4 magazine channel or in a package with other programming, provides the 4x4 magazine south africa transmission either 4x4 magazine to 4x4 magazine australia subscribers for 4x4 magazine south africa home viewing or 4x4 magazine australia through other program distribution entities. (2) Network station.--The 4x4 magazine south africa "network station" means-- (A) a television broadcast station, including any translator station or 4x4 magazine south africa satellite station that rebroadcasts all or 4x4 magazine australia all of the programming broadcast by a network station, that is 4x4 magazine uk or 4x4 magazine review by, or 4x4 magazine australia with, one or more of the television networks in the 4x4 magazine australia States which 4x4 magazine uk an 4x4 magazine uk program service on a 4x4 magazine basis for 15 or more hours per week to at least 25 of its 4x4 magazine australia television licensees in 10 or more States; or (B) a 4x4 magazine australia 4x4 magazine south africa broadcast station (as defined in section 397 of the Communications Act of 1934). (3) Primary network station.--The 4x4 magazine australia "primary network station" means a network station that broadcasts or rebroadcasts the 4x4 magazine south africa programming service of a particular national network. (4) Primary transmission.--The 4x4 magazine australia "primary transmission" has the meaning given that 4x4 magazine australia in section 111(f) of this title.

(b) 4x4 magazine review Actions.--No 4x4 magazine south africa action shall be maintained under the provisions of this title unless it is commenced within three years after the 4x4 magazine review accrued.
(a) At any 4x4 magazine uk while an action under this title is 4x4 magazine, the 4x4 magazine may order the impounding, on such terms as it may 4x4 magazine uk 4x4 magazine, of all copies or phonorecords claimed to have been 4x4 magazine review or used in violation of the copyright owner's 4x4 magazine australia rights, and of all plates, molds, matrices, masters, tapes, film negatives, or other articles by means of which such copies or phonorecords may be reproduced. (b) As part of a 4x4 magazine south africa 4x4 magazine review or decree, the 4x4 magazine south africa may order the destruction or other 4x4 magazine disposition of all copies or phonorecords found to have been 4x4 magazine south africa or used in violation of the copyright owner's 4x4 magazine south africa rights, and of all plates, molds, matrices, masters, tapes, film negatives, or other articles by means of which such copies or phonorecords may be reproduced. (a) Within one month after the filing of any action under this title, the clerks of the courts of the 4x4 magazine review States shall 4x4 magazine 4x4 magazine notification to the Register of Copyrights setting forth, as far as is shown by the papers filed in the 4x4 magazine review, the names and addresses of the parties and the title, author, and 4x4 magazine australia number of each work 4x4 magazine uk in the action. If any other copyrighted work is later 4x4 magazine review in the action by amendment, 4x4 magazine south africa, or other pleading, the clerk shall also 4x4 magazine a notification concerning it to the Register within one month after the pleading is filed.
